Walter HERBERT of St. Julian (Sir)

Notes: Succeeded father after 1504. Knighted 10 Nov 1549. Commissioner clerical tenths, diocese of Llandaff 1535, relief, Mon. 1550; deputy steward of Henry Somerset, 2nd Earl of Worcester, S. Wales by 1537-1538 or later; sheriff, Mon. 1541-1542, 1550-death, Justice of Peace 1543-death.

Nothing has come to light about Walter Herbert's upbringing or career until the 1530s when a quarrel with his father-in-law brought the pair into the Star Chamber. Other disputes about his title to land and avowsons, payment of rent and exercise of office under the Earl of Worcester involved him in further litigation and brought him regularly to the notice of the Council in the marches and of Cromwell. The protection given him by his kinsman Worcester ensured that he emerged largely unscathed from repeated charges of corruption and maintaining criminals, and on the enforcement of the Act of Union he was given a place in local administration.

Passed over as sheriff in favour of his cousin Charles Herbert in 1540, Herbert was pricked in the following year and during his shrievalty he returned the first Members for Monmouthshire and Monmouth Boroughs. After fighting in the Boulogne campaign he was himself elected with Charles Herbert in 1545, and two years later he helped to return his brother-in-law Sir Thomas Morgan and cousin Thomas Herbert. His knighthood in 1549 was a recognition of his public service and perhaps a reward for supporting John Dudley, Earl of Warwick, in the overthrow of the Protector Somerset. Herbert was a sick man on 30 Sep 1550 when he made his will providing for his wife and children and naming his son William executor and his kinsmen Sir William Herbert and Matthew Herbert of Cogan Pill, Glamorganshire, overseers. In Nov he was chosen sheriff again and a month later he was named to the commission to supervise the collection of the third part of relief, but on 17 Feb 1551 his son William replaced him as sheriff. His will was proved ten days later and a monument was erected over his grave at St. Woolos near Newport.

Married 1st by 1554, Jane, daughter and coheir of Edward Gruffydd of Penrhyn, Caern., and had 1 son, William; married 2nd by 1567, Dorothy. Succeeded father Sep 1550/Feb 1551. Sheriff, Mon. William Herbert's father died during his year as sheriff and there can be little doubt that it was Herbert who completed the term. He was not to enjoy the power and pretige accorded to his father in South Wales and he makes only occasional appearances in the records. Of his Membership of the Parliament of 1555 all that is known is that he was not among those who opposed one of the government's bills, unlike his fellow-knight and relative William Morgan. According to Herbert the pair were re-elected to the following Parliament, in 1558, but the sheriff returned Morgan and Francis Somerset, who was a son of Henry Somerset, 2nd Earl of Worcester. As Herbert's father had been in Worcester's service, the Earl perhaps counted on Herbert's acquiescence in Somerset's return, but Herbert took the matter to the Exchequer. The case was referred back to the Monmouthshire assizes, where a jury brought in a verdict upholding the validity of Somerset's election.

Herbert's marriage to one of the three daughters of Edward Gruffydd involved him in lengthy litigation against their uncle Sir Rhys Gruffydd over the partition of the Penrhyn estates. He made his will on 13 Jan 1567 when a sick man, and asked to be buried in the church at Christchurch, Monmouthshire. To his brother George Herbert he left the lease of his heir's lands in Anglesey and Caernarvon and all lands in Glamorgan, to his brother Miles a tenement at St. Michael's in Llantarnam and to his sister Barbara a sum of 33.06.08. The remainder, including all the goods and lands in Monmouth, went to his second wife Dorothy, who was named executrix. The will, which was witnessed by Matthew Herbert, Giles Morgan and William Morgan, was proved on 7 Feb 1567, Herbert having died on 13 Jan. possessed of lands in Monmouthshire worth more than 72 pounds per year.
